California Proposition 65 Update on 60-Day Notices of Violation

California Proposition 65, also known as the “Safe Drinking Water and Toxic Enforcement Act”, was enacted in 1986 with the purpose to guard drinking water from toxic substances and reduce human exposure to chemicals. The listed Proposition 65 chemicals are known to the state of California to cause cancer, birth defects, or other reproductive harm.  Those in potentially violation of the law may receive a “60-Day Notice of Violation”. It is required that the notice is sent to the potential offender no less than 60 days before taking legal action.

In November of 2020 314 60-day notices were sent and in December 2020 293 60 day-notices were sent. Over the years, phthalates tend to constitute the majority of notices, and that was the case in November/December of 2020. Just over 40% of the notices were for phthalates. Approximately 30% were for lead, cadmium, chromium, arsenic, acrylamide, formaldehyde etc.

Items that accounted for the notices included: food, bags, glassware, ceramics, vinyl aprons, bedding.
