California Proposition 65 Update on 60-Day Notices of Violation

California Proposition 65, also known as the “Safe Drinking Water and Toxic Enforcement Act”, was enacted in 1986 with the purpose to guard drinking water from toxic substances and reduce human exposure to chemicals. The listed Proposition 65 chemicals are known to the state of California to cause cancer, birth defects, or other reproductive harm.  Those in potential violation of the law may receive a “60-Day Notice of Violation”. It is required that the notice is sent to the potential offender no less than 60 days before taking legal action.

In April 2023, there were 256 60-day notices of violation sent for CA Prop 65. Over the years lead and phthalates have been the largest offenders and that is still currently the case. 46% of notices were for lead, 30% for phthalates, and 24% were for other chemicals.

Phthalate violations included the following items: bags, cases, pet products, packaging, footwear, eyelash curlers, and nail files. Lead violations included: glass and ceramic.

BPA violations included: laptop/phone covers.

PFOA violations included: mats, pads, and supplements.

Benzene, Titanium Dioxide, Diethanolamine, Hexavalent Chromium were also identified in products and notices served.
