Bisphenol S
California’s Office of Environmental Health Hazard Assessment (OEHHA) has added Bisphenol S, commonly called BPS, to their Proposition 65 list of restricted chemical compounds.
In the wake of emerging research indicating that exposure to BPS compounds caused female reproductive toxicity, the state’s Developmental and Reproductive Toxicant Identification Committee (DARTIC) requested relevant information to justify its inclusion on the Prop 65 list. After separate periods of data collection and public comment, DARTIC met and unanimously voted that a host of “scientifically valid testing according to generally accepted principles” clearly showed that BPS causes female reproductive toxicity. BPS was thus added to the Prop 65 list, effective December 29, 2023.
The warning requirement for BPS exposure goes into effect on December 29, 2024.
Warning Requirements

Proposition 65 is a consumer protection law that requires businesses to clearly label products and environments that would expose the public to compounds known to cause cancer, birth defects, or other reproductive harm. The OEHHA has outlined the general format of these warnings, which must include the following:
- Warning symbol
- Word “Warning”
- Name of components
- Type of harm
- Link to more information
