About Proposition 65
California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (better known as Proposition 65) brought forth an effort to inform citizens of the potentially harmful substances present in the products they consume. Specifically concerned with chemicals known or greatly suspected to cause an increase in either cancer rates or birth defects, the list of regulated chemicals grows yearly as new research emerges into potentially harmful compounds.
Prop 65 dictates that businesses must label their products with sufficient warning if they contain any of the nearly 950 materials that the state Office of Environmental Health Hazard Assessment (OEHHA) regulate. Businesses found to not comply with Prop 65 labeling requirements may face litigation and a punitive fine of up to $2500 per violation per day. This law applies to all businesses operating in California, regardless of where they are headquartered.
Labeling Exemptions
California has established Safe Harbor Limits (SHLs) for many of the chemicals on the Prop 65 list. These SHLs determine the daily dosage that is safe for human exposure, expressed either as the No Significant Risk Level (NSRL) or the Maximum Allowable Dose Level (MADL).
Products containing heavy metals above the allowable Prop 65 exposure limit are required to place an appropriate warning label on their product to warn consumers of exposure. Not all listed substances have an MADL or NSL, but approximately 300 items on the list do have an associated exposure limit.
Prop 65 Heavy Metals Testing
Some chemicals, such as heavy metals, are highly targeted for regulation because of their reputation among consumers as toxic materials. Heavy metals listed on Prop 65 include Antimony, Arsenic, Beryllium, Cadmium, Chromium, Lead, Mercury, Nickel, and Selenium. Lead and cadmium testing are requested most frequently due to recent Prop 65 settlements. The only way to be certain whether a product needs to be labeled according to Prop 65 is to have it tested for regulated chemicals.
